Terms of service

1. Agreement

These terms govern your use of the Everlasting Legacy Productions website, client portal and memorial hosting service. By submitting an application or creating an account you accept them.

2. Services and quotes

Production work begins only after a written quote has been accepted. All amounts are quoted and payable in Namibian dollars (N$) and include applicable Namibian taxes unless stated otherwise.

3. Payment

• A deposit of 50% is payable before filming or production begins.
• The balance is payable before final delivery or publication.
• Living legacy subscriptions carry a once-off setup fee and are then billed either monthly or annually in advance in N$. The chosen subscription is the recurring renewal charge, and no separate annual hosting renewal fee applies.
• Memorial packages include the stated hosting period, after which an annual hosting renewal fee applies.
• Overdue accounts may result in a memorial being unpublished after written notice.

If payment is not received by the due date, the account enters a 10-day grace period. After that period, public access, uploads, AI services and QR redirection may be suspended. The authorised client will then have 20 days to renew the service or request an export of authorised content, subject to the Terms and Conditions and Privacy Policy.

4. Your content

You retain ownership of all photographs, video, audio and text your family supplies. You grant us a licence to store, edit and display that material for the purpose of producing and hosting your memorial. You confirm that you have the right to supply it and the consent of any living person who appears in it.

5. Our production work

We retain copyright in the films, edits and page designs we produce. You receive a perpetual, worldwide licence to view, share and reproduce them for personal and family purposes. Commercial reuse requires our written permission.

6. Acceptable use

Memorial content must be truthful, lawful and respectful. We may refuse or remove material that is defamatory, infringing, hateful, or that discloses another living person's private information without consent.

7. QR remembrance codes

The physical QR code remains unchanged while the memorial service remains active. Its destination can be securely maintained, updated or suspended without replacing the engraved code. Issued codes and their web addresses remain stable for as long as your subscription is active. We may reassign the destination of a code at the memorial owner's written request, and we may suspend a code that is reported lost, stolen or misused.

Everlasting Legacy Productions provides long-term digital preservation subject to the selected service package, continued hosting, platform availability and the applicable Terms and Conditions.

8. AI assistance

AI-generated drafts are suggestions only. You are responsible for reviewing them for accuracy before approval and publication.

9. Availability

We aim for continuous availability but do not warrant uninterrupted service. Planned maintenance is announced in the client portal.

10. Liability

Our total liability arising from the service is limited to the fees you paid in the twelve months preceding the claim. We are not liable for indirect or consequential loss.

12. Governing law

These terms are governed by the laws of the Republic of Namibia and the courts of Namibia have exclusive jurisdiction.
